You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You also agree not to compromise the security of the website or attempt to gain access to secured areas or sensitive information.
You agree to be fully responsible for any claim, expense, liability, losses or costs, including legal fees, incurred by us arising from any infringement of the terms and conditions set out in this agreement.
As a condition of your use of this site you will not:
1) Post any unlawful, abusive, defamatory, obscene or indecent information or images.
2) Post or transmit any material or images of any kind that violates or infringes upon the rights of any other persons or any material that is protected via trademarks or any proprietary right, without receiving permission from the owner or relevant owner.
Advertising prices are guaranteed for the duration of the subscription period. We reserve the right to change our prices & policies anytime by publishing them on the website and revised prices & policies will come into effect for all renewals and new subscriptions contracted after the published date.
If you have signed up for an advertising trial, your advert will automatically expire at the end of the period unless you choose to renew it at the published rates in force at the time. There is no requirement for you to renew.
Periods of advertising are sold for calendar months starting from the date of initial activation of each property. You are able to temporarily or permanently deactivate your adverts but there is no discount or refund available for periods of time where you have chosen to deactivate your advert from our site.
If we receive a complaint about a listing misrepresenting the property, or its surroundings, or is any other way misleading or inappropriate then we reserve the right to remove the advertisement without notice, and retain payment;
We reserve the right to refuse or remove any advertisement from our site that we consider unsuitable, incomplete or misleading, or which we consider to contain Inappropriate Content, and will not be liable for any expense in so doing;
If an Advertiser wishes to have their advertisement removed from our site before the end of their subscription, this will be done as soon as we receive formal notice from the Advertiser by email from the email address registered on your Advertiser Account, quoting their Owner ID or Property number. No refunds will be given.
If an Advertiser is in breach of these terms we may remove the advertisement from our site without notice and without refund.
HolidayRoot.com offers a seven day cooling-off period, during which you may cancel your subscription and receive a full refund. To apply for a refund of your subscription fees during the cooling-off period, we must receive your refund request by email from the email address registered on your Advertiser Account to refund@HolidayRoot.com stating your Advert ID no later than seven weekdays after your initial subscription payment, and you must not have published any Advert during this period. Once your Advert has been published on our website, the cooling-off period is automatically terminated. The 'cooling off period' applies to the initial advertising period only; it cannot be applied beyond the first Subscription period. After seven days you shall not receive a refund as the payment received includes the costs of setting up the advert and S.E.O done for your property on the major search engines. (Unless you have a guarantee with your preferred subscription plan)
You may cancel your advertising subscription at any time. All payments made prior to the cancellation are non-refundable and there will be no refunds made for such payments, even on a pro rata basis. Instead, your right to use the services for which you have already paid will continue until the subscription period expires.
Holidayroot.com reserves the right to terminate your advertising subscription at any time for any reason.
Auto-renewal applies to products purchased by debit or credit card on or after July 10th, 2015. Once you have renewed your subscription after this date, your listing will automatically renew on the payment card specified on your account. This renewal will occur on the listing’s expiration date at the renewal rate for that date, in the currency you paid for previously, and will include VAT at the appropriate rate based on your country of residence, and whether you are running the property as a business. You will be informed by email up to 30 days prior to the renewal, and also on the day, the card is charged. You have the right to cancel the automatic renewal by giving 21 days notice of your intention to cancel. The automatic renewal will apply to;
12-month advertising at the price for the date of renewal.
12-month Featured Listings, if purchased with the current advertisement at the price for the date of renewal.
12-month Premium Listing Upgrade, if purchased with the current advertisement at the price for the date of renewal.
Extra Images if purchased with the current advertisement, at the price for the date of renewal.
If you would like to stop your adverts being auto renewed, then please email us on email@example.com, or contact us on the telephone numbers provided.
holidayroot.com do not store payment card information and are fully compliant with PCI-DSS.
RESPONSIBILITY FOR ACCURACY AND CURRENCY OF PROPERTY INFORMATION:
The advertiser agrees to indemnify Holiday Root claims or costs arising out of any misleading information in the advertisement.
HolidayRoot.com will take every care to reproduce faithfully all details text and photographs provided to us by advertisers. We will not, however, be held liable for any loss arising out of any error or omission on our part. HolidayRoot.com reserves the right to determine the design and layout of advertisements, and (at our discretion) make alterations to submitted text or photographs, should we consider any to be necessary. HolidayRoot.com will not be held liable for any loss arising out of such alterations.
HolidayRoot.com reserve the right to change any part of this agreement without notice. If you do not agree with the revised Terms and Conditions you have the right to be governed by the set of Terms and Conditions in force at the time of the commencement of your advert until such time as that advertising period expires. Any renewals of existing adverts or new adverts will be subject to the Terms and Conditions in force at the time of renewal
LIMITATION OF LIABILITY:
HolidayRoot.com will under no circumstance be liable for indirect, special or consequential damages, including any loss of business, revenue, profits or data in relation to your use of the Website.
All intellectual property of HolidayRoot.com such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the Website remain the property of Holiday Root.
By using the Website you agree to respect the intellectual property rights of HolidayRoot.com and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Website. HolidayRoot.com is designed for private use by persons searching for holiday or vacation homes.
The advertiser represents and warrants that he:
(1) Owns the copyright in the photographic and textual material supplied by him to HolidayRoot.com (the Material and Text) or
(2) Has been authorized by the owner of the copyright in the Material to grant HolidayRoot.com permission to use the Material as contemplated below.
The advertiser grants HolidayRoot.com a perpetual, royalty-free licence to use the Material for promotional purposes (including public relations material and marketing). The advertiser irrevocably and unconditionally indemnifies HolidayRoot.com immediately on demand against any cost, loss or liability (including legal costs), which HolidayRoot.com may incur by reason of any breach of copyright arising from its use of the Material. The advertiser understands that it may not reproduce photographic or textual material from any part of the HolidayRoot website without permission from the relevant copyright owner.
PROVISION OF SERVICES
We endeavour to ensure that the Website will be available 24 hours a day, every day of the year but can not guarantee uninterrupted availability of the www.holidayroot.com website and cannot provide any representation that using the website will be error free. HolidayRoot.com have complete discretion to add, modify, update or remove any part of this site without warning or liability arising from such action.

You agree to allow your property details in whole or in part to be individually featured, or featured as part of a group. All marketing and advertising is aimed towards generating enquiries through our website.
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.
By creating an account on the Website, you agree to provide a valid email address to be used as primary form of contact and to inform and update HolidayRoot.com if this address changes. You also agree that HolidayRoot.com may contact you by email with a monthly newsletter, with information regarding new services, offers and updates related to the Website and for matters related to the administration of your properties.

Traveler users of the Site will be given the option to receive our Traveler newsletter when they register with us. Inquiries can be sent to the individual member you selected and to our system. The resulting inquiry is available for review by the member to whom it was initially addressed and to our customer service people, who may share past inquiry information or information related to past stays including your contact details with members. We may also from time to time, use third party e-mail servers to send and track receipt of inquiry emails, and analyze the pattern of inquiry usage reported by this third party tracking systems.

Transfer of Holiday Rental
HolidayRoot.com memberships are easily transferable upon the date of transfer of holiday rental in case of property sold or transferred to new owner. Just provide us with the new owner's name, address and billing address and we will contact the new owner and do the needful upon their approval. If you wish to cancel your service due to sale or transfer, Cancellation policy will apply.
HolidayRoot.com account or listing can be canceled anytime. Just notify us and we will cancel the account and remove the Ad from our site in not more than 72 hours. No refund or Pro-Rated credit will be issued for cancellation by owner.
Listing and Content policies
HolidayRoot.com reserves the right to cancel or remove a listing which is not passed our audit procedure. We do periodic reviews on listings and any listing that does not qualify for our standards and terms, HolidayRoot.com reserves full right to delete or remove the listing. We want to create a family safe environment and want thousands of people to plan their holiday through our website so under any circumstances, HolidayRoot.com will not allow any vulgarity, comments related to violence, sexual nature or color discrimination. After submitting the property information on our site, it becomes copyrighted property on HolidayRoot.com and we reserve rights to alter, edit or delete part of the information which does not follow our listing policies.
HolidayRoot.com never participates in spamming and will not allow someone to do so through our website. Any unauthorized use of information by the third party will subject to copyright law violations and will subject to criminal prosecution.
Holiday Rental Inquiries
It is the goal of HolidayRoot.com to reduce the volume of SPAM delivered via the Holiday Rental Information and Availability Request (Inquiry) form. To that end, inquiries may be monitored and filtered by HolidayRoot.com prior to delivery to HolidayRoot.com holiday rental owners. Inquiries may be read by HolidayRoot.com staff members. Despite filtering efforts, it is possible that some SPAM inquiries will be delivered anyway.
Rental inquires are delivered via Internet email and are not to be considered private. Internet e-mail delivery is not 100% reliable and HolidayRoot.com cannot be held responsible for undelivered inquiries or for missed income as a result of undelivered inquiries. HolidayRoot.com, at its own discretion, may supply to potential renters the direct e-mail address of HolidayRoot.com advertisers for the purpose of making a rental inquiry.
HolidayRoot.com reserves the right to update or make changes to our main site at any time without notice.

In this "Provider" or "Providers" refers to homeowners who have or wish to advertise their properties on HolidayRoot.com
Subscriptions for property advertisements shall be renewed automatically if a Provider indicates that they wish the advertisement to be renewed automatically at either the time they initiate the advertisement subscription or at a time subsequent to that request. Providers may cancel their subscription renewal without such a cancellation affecting the current advertising period (i.e. the full period of advertising already purchased will continue before the listing expires).
In order to cancel a subscription, Providers may either log in to their HolidayRoot.com profile and disable the automatic renewal feature. If the Provider elects to use the latter e-mail option to cancel their subscription, they must send the request at least 3 business days prior to the renewal. You agree that HolidayRoot.com will not be held responsible if a renewal is conducted when less than three days’ notice is given by you when you elect to disable the renewal via e-mail.
When renewing property advertisements, HolidayRoot.com will send an e-mail notice to the e-mail address on file for the Provider indicating the upcoming charge. The Provider’s credit card on file with HolidayRoot.com will be charged with the appropriate fee. If a Provider paid using a credit card or other method that can be charged without further assistance from the Provider, that credit card will be charged with the relevant amount. If another method of payment was used or the credit card has expired, HolidayRoot.com will notify the Provider and request an update of their payment information, failure to comply with which will result in the non-renewal of the Property advertisement.
HolidayRoot.com will send a confirmation e-mail whenever a payment or subsequent renewal is made successfully by a Provider.
If the price of a subscription level has increased since the Provider first purchased it or last renewed it, HolidayRoot.com shall notify the Provider of the increase prior to the expiration of the current advertising period, and shall be entitled to automatically charge the Provider for the higher rate at the time of renewal unless the Provider cancels their subscription.
